SELLER OBLIGATIONS

The SELLER, NaughtyNature Cattery, provides a 72-hour limited warranty guarantee that the above kitten / cat is in good health at the time of purchase. The SELLER also warranties that the kitten is free of the feline leukemia virus (FeLV), feline infectious peritonitis (FIP), and the feline immunodeficiency virus (FIV) at the time of purchase. The BUYER must notify the SELLER of any claim under the warranty immediately. If a veterinarian finds the above kitten / cat to have a life-threatening illness, he / she should write and sign a short note on his / her letterhead stationary explaining his / her findings. The kitten may be returned to the SELLER for a full refund or exchange for a new kitten / cat. If no replacement is available at the time of return, the SELLER will have up to one year to furnish a comparable kitten / cat. The kitten / cat cannot be returned for compensation after the guaranteed period has expired and / or if the above kitten / cat has been exposed to another cat. SELLER will not honor any health guarantee if the kitten / cat dies of a virus from contact with another animal not bred by SELLER. It is highly recommended that the above kitten / cat be quarantined during that 72-hour warranty period. Under NO circumstances is the kitten / cat allowed to be “destroyed” prior to notification of the SELLER. SELLER is not responsible for illness, injury, or death caused by or during shipping. We prefer that you come in person to pickup the above kitten / cat.

If the kitten described above should die within a year of the date of purchase due to a congenital or hereditary defect, the SELLER will replace the kitten / cat with another kitten / cat of equal or better quality at no cost to BUYER. The SELLER must receive proof of the defect in the form of a complete autopsy report completed by a licensed veterinarian and performed at the BUYER’s expense. The SELLER will make every attempt to replace the kitten / cat with a kitten / cat of equal or better color, marking, and quality within a timely manner. The SELLER reserves the right to reserve a cash refund.

The SELLER will have completed all of the age-appropriate vaccinations, worming, medical examining, and by the time of purchase. If the BUYER chooses to vaccinate for feline infectious peritonitis (FIP), ringworm, feline leukemia virus (FeLV), or feline immunodeficiency virus (FIV), this warranty is *VOID*. Also, SELLER will not warranty the kitten against any adverse reactions to future vaccinations.

The SELLER will provide the BUYER with the kitten / cat’s registration from The International Cat Association (TICA) and pedigree at the time of purchase or in a timely manner.

BUYER OBLIGATIONS

BUYER accepts the responsibility of caring for the kitten / cat and will provide properly for its welfare. BUYER agrees to keep the kitten / cat indoors at all times in a clean and pleasant environment, not caged, and with proper nutrition, health care (including yearly veterinarian examinations and vaccinations), companionship, and adequate space for exercise. Above kitten / cat is only allowed outdoors while on a leash and while under close supervision.

Due to the lack of fur, Sphynx are more easily chilled than some other breeds. BUYER agrees to provide a suitable warm place for the kitten / cat at all times. We also suggest that you clean litter boxes daily and provide at least one litter box per each two cats. We feed and recommend Nature’s Variety Raw Instinct, Wellness, and Science Diet Hairball food. We also use and recommend Feline Pine pellet litter.

BUYER understands that if the kitten / cat is found to be neglected or mistreated in any way SELLER shall have the unconditional right to reclaim the above kitten / cat without refund of the purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for periods in excess of 72 hours, lack of proper sanitary facilities, being caged, providing poor diet, and poor health. Mistreatment shall include, but is not limited to: lack of proper food, lack of proper medical care, lack of fresh water, and any form of physical abuse. BUYER will be responsible for any veterinary bills directly incurred as a result of any neglect or mistreatment.

BUYER understands that if the kitten / cat is declawed it will render the guarantee *VOID*. BUYER understands that declawing is a mutilation involving the amputation of a large portion of the kitten / cat’s toes, which is likely to alter the kitten / cat’s temperament and general well-being. BUYER agrees that above kitten / cat will NEVER be declawed and that adequate scratching posts and regular nail trimming will be provided.

BUYER agrees that under NO circumstances will the kitten / cat ever be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar facility. Should BUYER not be able to keep the above kitten / cat for any reason, including the incapacitation or death of the BUYER, the SELLER has the first option to take / buy the above kitten / cat back or assist in finding a suitable new home for the kitten / cat. This remains in effect for the entire life of the kitten / cat.

NOTE: It is understood that degrees of hairlessness in Sphynx vary from cat to cat and that no Sphynx is completely hairless. It is understood that hormones, climate, and genetics play an important role in hairlessness and that even though a Sphynx kitten may be almost hairless when sold, it is possible that said kitten could develop some hair after being neutered / spayed or as it grows older. It is also impossible to guarantee that any Sphynx kitten / cat will not grow some hair at some point in the future.

SELLER agrees to provide weekly baths and ear cleanings along with daily eye cleaning (as required). The above kitten / cat will leave this Cattery freshly bathed with trimmed nails and freshly cleaned ears.

Any legal action which may arise under the terms of this contract will be brought in Dallas County, Texas, USA. BUYER shall be liable for any court costs and related charges including attorney’s fees associated with SELLER enforcing the terms of this contract. In signing this document, BUYER acknowledges that he / she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State of Texas shall be controlling.

BUYER and SELLER agree to ALL of the above stated terms.
